Welcome to Shmoogle (www.shmoogle.com). By accessing or using our website, creating an account, or submitting a listing, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the site.

1. Who We Are

Shmoogle is a Jewish community directory that helps users discover businesses, synagogues, kosher restaurants, schools, and other organizations. We are not affiliated with any religious denomination or governing body.

2. Eligibility

You must be at least 13 years old to use this site. By creating an account, you represent that you are at least 13. If you are under 18, you may only use the site with parental consent.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating an account and to keep it up to date. You are responsible for all activity that occurs under your account. Notify us immediately at legal@shmoogle.com if you believe your account has been compromised.

4. Listing Content

Listings submitted by users are subject to review before publication. By submitting a listing, you represent that:

  • You have the right to submit the information
  • The information is accurate to the best of your knowledge
  • The listing does not infringe any third-party rights

Shmoogle reserves the right to reject, edit, or remove any listing at our sole discretion.

5. Reviews

User reviews must be honest, based on genuine experience, and free from defamatory, harassing, or hateful content. We reserve the right to remove reviews that violate these standards.

6. Prohibited Conduct

You agree not to:

  • Use the site for any unlawful purpose
  • Submit false, misleading, or fraudulent listings or reviews
  • Scrape, crawl, or otherwise extract data from the site without written permission
  • Attempt to gain unauthorized access to any part of the site
  • Harass, threaten, or harm other users
  • Post spam, commercial solicitations, or off-topic content
  • Use the site to discriminate against individuals based on religion, race, national origin, or any protected characteristic

7. Intellectual Property

All content on Shmoogle — including the site design, logo, and compiled directory data — is owned by or licensed to Shmoogle. You may not reproduce, distribute, or create derivative works without our express written permission. User-submitted content remains yours; by submitting it you grant Shmoogle a non-exclusive, royalty-free license to display and distribute it as part of the directory.

8. Disclaimer of Warranties

The site and its content are provided "as is" without warranties of any kind. Shmoogle does not guarantee the accuracy, completeness, or reliability of any listing, review, or other content. We are not responsible for the quality, safety, or legality of any business or organization listed.

9. Limitation of Liability

To the fullest extent permitted by law, Shmoogle shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — the site or any listing found through it. Our total liability to you shall not exceed $100.

10. Indemnification

You agree to indemnify and hold harmless Shmoogle and its operators from any claims, damages, or expenses (including reasonable attorneys fees) arising from your use of the site, your submitted content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised version with a new effective date. Continued use of the site after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York County, New York.

14. DMCA & Copyright

Shmoogle respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on Shmoogle infringes your copyright, please send a written notice to dmca@shmoogle.com containing:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to have been infringed
  • The URL or specific location of the allegedly infringing material on Shmoogle
  • Your contact information (name, address, phone, email)
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

We will review valid notices and remove infringing material promptly. We may also terminate the accounts of repeat infringers. If you believe content was removed in error, you may submit a counter-notice with the same information to the same address.
